Terms of Service

These Terms of Service ("Terms") govern your use of the AeroTail mobile application and related services ("Service") developed and operated by Souvik Biswas ("Developer"), an individual developer based in India. By using AeroTail, you agree to these Terms.
1. Description of Service
AeroTail is a real-time aircraft tracking application that displays nearby aircraft on a map and sends proximity alerts when aircraft enter a configurable detection radius. The Service is available on iOS and Apple Watch.
2. Aircraft Data Disclaimer
Aircraft data displayed in AeroTail is sourced from publicly available ADS-B feeds and third-party APIs. This data is provided for informational and entertainment purposes only.
- Aircraft positions, altitudes, speeds, and flight details may be inaccurate, delayed, or incomplete.
- Not all aircraft broadcast ADS-B signals. Military, private, and some commercial aircraft may not appear.
- AeroTail is not an air traffic control tool and must not be used for aviation safety, navigation, or any operational decisions.
- The Developer does not guarantee the accuracy, completeness, or timeliness of any aircraft data.
3. Account and Authentication
You may sign in using Apple or Google authentication. You are responsible for maintaining the security of your account credentials and any activity that occurs under your account. The Developer is not liable for any loss resulting from unauthorized use of your account.
4. Subscriptions and Payments
AeroTail offers free and paid subscription tiers with different feature limits:
- Free — Fixed 4 km detection radius, limited daily notifications and flight detail views.
- Pro — Adjustable detection radius (up to 50 km), unlimited notifications and flight details.
- Ultra — All Pro features plus Apple Watch app access.
Paid subscriptions are billed through Apple's App Store on a monthly or yearly basis. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.
All billing, renewals, refunds, and cancellations are handled entirely by Apple. Refer to Apple's terms and policies for refund requests.
The Developer reserves the right to change subscription pricing or features. Existing subscribers will be notified before any changes take effect on their next renewal.
5. Acceptable Use
You agree to use AeroTail only for lawful purposes. You may not:
- Use the Service for any purpose that violates applicable laws or regulations
- Attempt to reverse-engineer, decompile, or extract source code from the app
- Use the Service to track, stalk, or harass individuals, or to interfere with aviation operations
- Redistribute, resell, or commercially exploit aircraft data obtained through the Service
- Circumvent usage limits, subscription restrictions, or other technical measures
- Use automated systems or bots to access the Service
6. Location Services
AeroTail requires location access to display nearby aircraft and deliver proximity notifications. By granting location permission through the iOS system prompt, you consent to your device's location being collected and stored on our servers for this purpose. Location data is stored anonymously on a device record that is not linked to your user identity. You may revoke location access at any time through iOS Settings, though this will disable proximity alerts.
7. Push Notifications
Proximity alert notifications are delivered via Apple Push Notification Service and Firebase Cloud Messaging. Notification delivery is not guaranteed and may be affected by network conditions, device settings, or system limitations. The Developer is not liable for missed or delayed notifications. You can disable notifications within the app or through iOS Settings.
8. Intellectual Property
The AeroTail app, including its design, code, graphics, and branding, is the intellectual property of the Developer and is protected by applicable intellectual property laws. Aircraft data is provided by third-party sources and is subject to their respective terms of use. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.
9. Disclaimer of Warranties
AeroTail is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Developer does not warrant that the Service will be uninterrupted, error-free, secure, or accurate. Aircraft data may contain errors, omissions, or delays.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Service, including but not limited to damages arising from reliance on aircraft data, missed notifications, service interruptions, or data loss. In no event shall the Developer's total liability exceed the amount you have paid for the Service in the 12 months preceding the claim.
11. Termination
The Developer may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at the Developer's sole discretion, with or without notice. You may stop using the Service at any time by deleting the app. You can delete your account and associated data directly within the app via Settings, or by contacting support@aerotail.app.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Kolkata, India.
13. Changes to These Terms
The Developer may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of AeroTail after changes constitutes acceptance of the revised Terms. For material changes, the Developer will make reasonable efforts to notify users.
